지난 4일 점심시간, 서울 광화문 LG빌딩 앞. 가습기 살균제 참사 해결을 위해 적극적으로 활동하고 있는 환경보건시민센터를 중심으로 기자회견이 하나 열렸습니다. 기자들에게 사전에 알린 일정이었지만, 현장에는 딱 1곳의 언론사만 왔습니다. 기자회견인데 정작 기자는 없는 셈, 언론의 관심 밖이라는 방증이었습니다.

최예용 환경보건시민센터 소장은 썰렁한 현장을 두고 이렇게 말했습니다. "저희가 이맘쯤 되면 매년 기자회견을 열었는데, 2021년에는 기자들이 많이 왔어요. 그런데 '뉴스'라는 기준으로 보면 새로운 내용이 없다 보니 이후에는 관심이 줄어든 것 같아요. 하지만 변화가 없다는 게 오히려 뉴스 아닙니까?"
 

■ 3년 전 새벽 3시, 인도에선 무슨 일이?

환경단체가 5월이 되면 관심을 촉구하는 이 사안, 정확히 3년 전인 2020년 5월 7일 인도에서 발생한 가스누출 사고입니다. 사고 장소는 인도 남부 안드라프라데시주 비사카파트남에 위치한 'LG폴리머스 인디아' 공장입니다. LG화학이 1996년 인도 시장에 진출하며 인수한 현지 첫 사업장입니다. LG화학이 지분 100%를 보유하고 있습니다.

사고가 난 시간은 새벽 3시쯤. 대부분이 잠든 시각, 저장탱크가 터지면서 스타이렌(styrene)이라는 유독가스가 누출됐습니다. 누출량은 8백 톤 정도였습니다. 국제암연구소(IARC)는 스타이렌을 발암물질로 분류하고 있고, 한국산업안전보건공단은 중추신경계 손상과 말초 신경독성을 유발하는 물질로 분석했습니다.


■ 어린이 2명 포함 15명 숨져…동·식물도 피해

깊은 새벽 시간, 갑자기 발생한 가스 누출사고로 결국 15명이 숨졌습니다. 6살과 10살 어린이가 사망자 명단에 올랐고, 최고령 사망자는 73살이었습니다. 병원에 실려 간 주민은 5백여 명, 공장 반경 5km안에 있는 주민 2만여 명이 긴급 대피했습니다.

동·식물과 토양 오염도 발생해 당일에만 소와 돼지 등 가축 34마리가 폐사했습니다. 인도 당국은 반경 5km 이내에서 곡물의 50%, 파파야 90%가 썩는 등 농작물 오염이 의심된다며 먹거나 팔지 말라고 권고했습니다. 가스누출은 사람에게도, 자연 환경에도 악영향을 미쳤습니다.

■ '가능한 모든 지원 보장하겠다'던 LG화학…3년 지난 지금은?

LG화학은 사고 직후 2백 명 규모의 전담조직을 꾸려 위로 방문과 주민 지원, 핫라인 운영 등을 하고 있다고 보도자료를 냈습니다. 당시 기사를 찾아보면 LG화학은 ▲정부 기관과 협의해 가능한 모든 지원 보장 ▲지정병원 통해 치료 제공 ▲중장기 사회공헌활동 추진 등을 약속했습니다. 그러면서 "사고를 최대한 빨리 수습하겠다"고 언론에 밝혔습니다.

3년이 지난 지금, LG화학은 그동안 어떤 조치를 취했을까요? 물었습니다.

LG화학 관계자는 "사고가 난 지역의 주 정부에 20억 원 규모의 의료 관련 구호물품을 보냈고, 급수차가 필요하다고 해서 급수차도 기부했다. 현지에 종합병원을 지정해 주민 2천여 명의 치료 지원을 계속하고 있다"고 밝혔습니다.

■ LG화학 "227억 원 공탁…종합적인 보상은 인도 법원 판단 이후에 가능"

다만 사망자나 부상자 등 피해자들에 대한 LG화학 측의 직접적인 배·보상은 아직 진행되지 않고 있습니다. LG 화학은 그 이유로 인도 법원(안드라프라데시주 고등법원 및 인도환경재판소)에서 선고가 내려지지 않았기 때문이라고 밝혔습니다.

관계자는 "인도 법원에 총 227억 원이 공탁돼있다. 종합적인 보상은 법원 판단이 나온 이후에 할 수 있다"면서 "법원에 신속히 재판을 진행해 달라고 요청하고 있고, 기다릴 수밖에 없는 입장"이라고 전했습니다. LG화학 입장에선 법에서 정한 책임의 범위와 절차가 중요할 수도 있습니다. 문제의 해결과 예방이 법과 제도에 따라 진행돼야하는 점도 중요합니다.


■ 환경단체 "만약 여수에서 나고 났다면, 재판만 기다렸을까?"

환경단체 측은 LG화학이 법적인 책임을 지는 것은 당연하다고 말합니다. 그러나 인도 재판이 느리게 진행되는 점과 기업의 불복 절차까지 더해진다면 5년, 10년, 그 이상의 시간이 걸릴 수도 있다고 우려합니다. 법적 책임에 앞서 도의적인 책임을 요구하는 이유입니다.

최예용 환경보건시민센터 소장은 '역지사지'를 말합니다.

최 소장은 "만약 여수 산업단지에 있는 LG화학에서 독가스가 누출돼 수만 명이 대피하고, 15명이 사망한 참사가 일어났다면 어떻겠냐. 재판이 진행 중이니 결과를 기다리겠다고 하면서 제대로 된 배·보상 없이 3년을 있겠느냐. 절대 그렇지 않았을 것"이라고 말했습니다. 이어서 '가습기 살균제 참사' 를 떠올립니다.

■ "영국 옥시가 우리나라에서 그랬던 것처럼…우리 기업은 인도에서"


"영국의 다국적기업 옥시 레킷벤키저와 독일의 다국적기업 헨켈. 바로 이런 기업들이 유럽에서는 만들지도 팔지도 못하는 가습기 살균제를 우리나라에서 팔았습니다. 한국 소비자들 수 만, 수십만 명이 다치거나 죽었습니다. 유럽 다국적 기업이 한국에서 벌인 짓입니다."

"그런데 한국의 다국적기업 LG가 인도에서 무책임한 짓을 벌이는 것입니다. 개발도상국에서 벌인 참혹한 참사와 무책임한 행동을 기억해야 합니다. 대한민국이 선진국에 진입했다고 자부심을 갖는 시대에 우리 기업들은 어떤 모습을 하고 있을까요? 제대로 된 기업책임을 다하도록 우리들은 관심을 갖고 지적해야 합니다."

■ ESG(환경·사회·지배구조) 경영은 세계적 추세…

한국 ESG기준원(KCGS)이 평가한 LG화학의 ESG 등급은 7개 등급 중 다섯 번째인 B등급입니다. LG그룹 8개 계열사 가운데 가장 낮습니다. 국내외 공장에서 여러 안전사고가 발생하고, 환경경영 체계가 구축돼 있지 않은 점 등이 반영됐습니다.

글로벌 평가기관인 MSCI(모건스탠리캐피털인터내셔널)는 LG화학의 ESG 경영에서 미흡한 부분으로 '유독성 물질 배출 및 폐기물'을 꼽았습니다.

한국ESG경영원은 환경과 사회를 생각하는 경영은 '선택이 아닌 필수'라고 했습니다. ESG를 강화하지 않으면 기업이든 국가든 나락으로 떨어져 국민 생계가 어려워질 수 있다고 경고했습니다.

환경보건시민센터는 코로나19로 방문이 어려웠던 인도 사고 현장을 이번 달 찾아 주민들을 만나고, 피해 지역의 현재 모습과 주민 지원이 이뤄지고 있는지 확인할 계획입니다.

At lunchtime on the 4th, in front of the LG Building in Gwanghwamun, Seoul. A press conference was held around the Asian Citizen’s Center for Environment and Health, which is actively working to resolve the humidifier disinfectant disaster. It was a schedule that informed reporters in advance, but only one media company came to the scene. It was a press conference, but there were no reporters, which was proof that it was out of the media's interest.

Choi Yeyong, director of the Asian Citizen’s Center for Environment and Health, said this about the bleak site. "By this time of year, we had an annual press conference, and there were a lot of reporters in 2021. However, based on the standard of 'news', there is no new content, so interest seems to have decreased afterwards. But isn't it rather news that there's no change?“

■ 3am 3 years ago, what happened in India?

This issue, which environmental groups call for attention in May, is exactly three years ago, a gas leak in India on May 7, 2020. The site of the accident is the 'LG Polymers India' plant located in bisakapatnam, Andhra Pradesh, southern India. It is the first local business site that LG Chem acquired when it entered the Indian market in 1996. LG Chem owns 100% of the shares.

The accident happened around 3 a.m. When most of them were asleep, the storage tank exploded, leaking toxic gas called styrene. The leak was about 800 tons. The International Cancer Institute (IARC) classifies styrene as a carcinogen, and the Korea Occupational Safety and Health Agency analyzed it as a substance that causes damage to the central nervous system and peripheral neurotoxicity.

■ Fifteen people, including two children, died…Animals and plants were also damaged

At deep dawn, 15 people were eventually killed in a sudden gas leak. Children aged 6 and 10 were on the death list, and the oldest was 73. More than 500 residents were taken to the hospital and 20,000 residents within a 5km radius of the factory were evacuated.

Animal, plant, and soil contamination also occurred, killing 34 livestock, including cows and pigs, on the same day alone. Indian authorities have advised against eating or selling, saying they suspect crop contamination, with 50% of grain and 90% of papaya rotting within a 5km radius. Gas leakage has had an adverse effect on both humans and the natural environment.

■ LG Chem, who said, "We will guarantee all possible support."What about 3 years later?

Shortly after the accident, LG Chem released a press release that it has set up a dedicated organization of 200 people to visit comfort, support residents, and operate hotlines. Looking at the article at the time, LG Chem promised to ▲ ensure all possible support in consultation with government agencies ▲ provide treatment through designated hospitals ▲ promote mid- to long-term social contribution activities. He told the media, "We will fix the accident as soon as possible.“

Three years later, what has LG Chem done? I asked.

An official from LG Chem said, "We sent medical relief goods worth 2 billion won (US$1.5 million) to the state government in the area where the accident occurred, and donated water trucks because they needed water trucks. "We have designated a general hospital in the region and continue to provide treatment support for more than 2,000 residents," he said.

■ LG Chem deposited 22.7 billion won (US$17 million)... Comprehensive compensation is possible after Indian court judgment

However, direct compensation from LG Chem for victims such as the dead or injured has not yet been made. LG Chem said the reason was that no sentencing was made in an Indian court (Andhra Pradesh State High Court and the Indian Environment Court).

An official said, "A total of 22.7 billion won is deposited in the Indian court. Comprehensive compensation can be made after the court's judgment is made, he said. "We are asking the court to proceed with the trial quickly, and we have no choice but to wait." For LG Chem, the scope and procedures of responsibility set by law may be important. It is also important that the solution and prevention of problems should be carried out in accordance with laws and systems.

Environmental group "If there was an accident in Yeosu, Korea, would you have waited for the trial?"

Environmental groups say it is natural for LG Chem to take legal responsibility. But they fear it could take five or ten years, or more, if the Indian trial adds to the slow progress and corporate complaints process. This is why moral responsibility is required prior to legal responsibility.

Director Choi said, "What would have happened if toxic gas leaked from LG Chem in Korea's Yeosu Industrial Complex, causing tens of thousands of people to evacuate and 15 people to die? Since the trial is underway, will you stay for three years without proper compensation, saying that you will wait for the results? No, it would never have been." He then recalls the 'humidifier disinfectant disaster'.

■ "Just as the British Oxy Reckitt Benckiser did in our country…Korean company operate in India"

"Oxy Reckitt Benckiser, a British multinational, and Henkel, a German multinational. These companies sold humidifier disinfectants in Korea that could not be made or sold in Europe. Tens of thousands of Korean consumers have been injured or killed. It was done in Korea by a multinational European company."

"But LG, a Korean multinational, is doing something irresponsible in India. We must remember the horrendous disasters and irresponsible behavior in the developing world. What are our companies like in an era where we are proud that Korea has entered an advanced country? We must point out with interest to fulfill our proper corporate responsibilities."

■ ESG (Environmental, Social, and Governance) Management is a Global Trend...

LG Chem's ESG rating, which was evaluated by the Korea ESG Standards Institute (KCGS), is B grade, the fifth of the seven grades. It is the lowest among LG Group's eight affiliates. It reflects the fact that several safety accidents occurred at domestic and foreign factories and that the environmental management system was not established.

MSCI (Morgan Stanley Capital International), a global evaluation agency, cited "toxic material emissions and waste" as an insufficient part of LG Chem's ESG management.

The Korea ESG Management Institute said that management that cares about the environment and society is a must, not a choice. He warned that if ESG was not strengthened, businesses and countries could fall into the abyss, making it difficult for people to make a living.

The Asian Citizen's Center for Environment and Health plans to visit the accident site in India this month, which was difficult to visit due to COVID-19, to meet with residents, and to check the current status of the affected area and whether support for residents is being provided.
